These Terms of Use (“Terms”) govern your use of https://www.birdslanding.net (the “Site”). By accessing or using the Site, you agree to these Terms.
1. About Birds Landing and the Site
Birds Landing LLC operates a shooting sports facility offering, among other services:

Sporting clays reservations (no online payments for clay reservations).

Hunting bookings through a member portal (payment at booking via Clover; waiver required before going afield).

Annual memberships for sporting clays and hunting (no automatic renewal).

Rentals and on-premises activities (ID required; minors allowed only with a parent/guardian and subject to staff safety judgment).

2. Eligibility, Safety, and Participation Rules
A. Minors

Sporting clays: no age restriction if a parent/guardian is present, but participation depends on the minor’s ability to safely handle a firearm; minors may be on the course as spectators/non-shooters.

Hunting: participants must possess a California hunting license; a non-hunter may go afield at any age with a parent/guardian.

Rentals: a parent/guardian must be present.
B. Identification
Renters are required to present a driver’s license.
C. Our Discretion to Refuse Service
For safety and operational reasons, Birds Landing may refuse participation or service to any person who cannot demonstrate safe handling or who violates facility rules.
3. Reservations
A. Sporting Clays Reservations

Sporting clays reservations are processed through our website host (Wix).

We do not collect payment or a credit card number to book a sporting clays reservation.
-
No-show penalty: none.
-
Cancellation/rescheduling: you may cancel by phone or email and reschedule by phone or through the website.
B. Hunting Reservations

Hunting reservations are processed through Lodgerunner.
-
Payment is collected at booking through Clover.
-
Cancellation: customers can cancel online within 24 hours; otherwise, they must call or email to receive a credit.

Credits: credits generally do not expire but may not be issued if the member does not rejoin for the next year; credits may be applied toward next year’s membership.

Refunds: we generally do not refund back to the credit card.
4. Membership Terms (Summary)
Full Membership Terms are incorporated by reference and are included below in Section 13.
5. No Online Firearm or Ammunition Sales
Firearms and ammunition are not sold online.
All firearm and ammunition sales are subject to federal, state, and local laws and eligibility requirements.
6. Ammunition Compliance Notice (California)
Ammunition purchases outside of on-premises same-day use may be subject to a California DOJ background check requirement, and Birds Landing must comply as a licensed vendor. Ammunition used on a gun club’s premises on the day of purchase may be exempt from the background check requirement.
We require our ammunition to be used in our rental guns for liability and safety concerns.
7. Assumption of Risk
Shooting sports and related recreational activities involve inherent and obvious risks, including serious injury or death, property damage, hearing loss, and harm caused by firearms, ammunition, equipment failure or malfunction, misfires, user error, unsafe handling by you or others, terrain, wildlife, weather, and other conditions. By accessing the Site, visiting our facility, renting or using equipment, or participating in any activity booked or described on the Site, you acknowledge and knowingly and voluntarily assume all such risks to the fullest extent permitted by law. You understand that risks may arise from your own actions or inactions, the actions or inactions of others, or the condition of the premises and equipment.
A. Rules Compliance; Safety Waivers
You agree to comply with all posted rules, staff instructions, safety protocols, and applicable laws and regulations at all times. Certain activities require execution of our waiver and release before participation; if a waiver applies to your activity, it is incorporated by reference and supplements (and does not limit) these Terms.
8. Waivers
Hunting participants sign an electronic waiver managed through Lodgerunner, and the waiver is required before going afield. Sporting clays participants may be required to sign a waiver for certain events or activities, and any such waiver will be provided by staff or electronically.
Any applicable waiver is incorporated by reference and supplements (and does not limit) these Terms.
9. Prohibited Uses
You agree not to:

Use the Site for unlawful purposes

Attempt to interfere with the Site’s operation or security

Misrepresent your identity

Copy or scrape Site content without permission
10. Intellectual Property
All content on the Site (text, images, logos, videos, design elements) is owned by Birds Landing or its licensors and may not be used without written permission.
11. Disclaimers
THE SITE AND ALL CONTENT ARE PROVIDED “AS IS” AND “AS AVAILABLE.” WE DISCLAIM ALL WARRANTIES TO THE MAXIMUM EXTENT PERMITTED BY LAW, INCLUDING IMPLIED WARRANTIES OF MERCHANTABILITY, FITNESS FOR A PARTICULAR PURPOSE, AND NON-INFRINGEMENT.
12. Limitation of Liability
TO THE MAXIMUM EXTENT PERMITTED BY LAW, BIRDS LANDING SHALL NOT BE LIABLE FOR ANY INDIRECT, INCIDENTAL, CONSEQUENTIAL, SPECIAL, EXEMPLARY, OR PUNITIVE DAMAGES, OR FOR ANY LOSS OF PROFITS, REVENUE, DATA, OR GOODWILL, ARISING FROM OR RELATED TO YOUR USE OF THE SITE OR PARTICIPATION IN ACTIVITIES DESCRIBED OR BOOKED THROUGH THE SITE, EVEN IF ADVISED OF THE POSSIBILITY OF SUCH DAMAGES.
IN NO EVENT SHALL BIRDS LANDING’S TOTAL LIABILITY EXCEED THE GREATER OF: (A) AMOUNTS PAID BY YOU TO BIRDS LANDING THROUGH THE SITE IN THE SIX (6) MONTHS PRIOR TO THE EVENT GIVING RISE TO THE CLAIM, OR (B) $100.00.
THIS LIMITATION DOES NOT APPLY WHERE PROHIBITED BY LAW, INCLUDING LIABILITY FOR GROSS NEGLIGENCE, RECKLESSNESS, OR WILLFUL MISCONDUCT.
13. Membership Terms (Incorporated)
A. General

Sporting clays and hunting memberships are annual.
-
No automatic renewal.
-
Birds Landing may terminate memberships for rule violations or safety issues in its discretion.
B. Sporting Clays Membership – No Refunds and Targets
-
“No refunds” applies to the annual sporting clays membership fee, which is non-refundable under all circumstances.

Unused target balances are non-refundable but do not expire.
-
As a general practice, Birds Landing does not refund other items listed on the site (including rentals/targets/gift certificates).
C. Hunting Membership – Credits and Transfers

Credits are generally provided when cancellations occur; credits generally do not expire but may not be issued if the member does not rejoin for the next year.

Credits may be applied toward next year’s membership.
-
Membership pricing level may be transferred to a family member or known hunting partner for a transfer fee, subject to staff approval, and typically documented.

Early payment bonus may be available if paid prior to May 1 for the upcoming year.
D. Changes
Birds Landing may change membership terms, pricing, benefits, or rules, and will apply changes prospectively.
14. Indemnification
You agree to defend, indemnify, and hold harmless Birds Landing and its owners, managers, employees, and agents from any claims arising out of your use of the Site, violation of these Terms, or participation in any activity, except to the extent caused by Birds Landing’s gross negligence or willful misconduct.
15. Governing Law and Venue
These Terms are governed by California law. Exclusive venue for any permitted court action shall be in Solano County, California.
All disputes, claims, or controversies arising out of or relating to these Terms or the Site shall be resolved exclusively in the state or federal courts located in Solano County, California. The parties’ consent to personal jurisdiction and waive any objection to venue or forum non conveniens.
16. Changes to These Terms
We may update these Terms from time to time by posting the updated version on the Site.
A. Severability
If any provision of these Terms is found unenforceable, the remaining provisions will remain in full force and effect to the maximum extent permitted by law.
B. Assignment
You may not assign or transfer these Terms or any rights or obligations hereunder without our prior written consent. We may assign these Terms, in whole or in part, in connection with a merger, acquisition, corporate reorganization, sale of assets, or by operation of law.
